Swiss MultinationalPharmacuetical company Novartis is continuing its tradition of suing developing country governments for their pro-health patent laws. In 1999, Novartis along with other pharmaceutical companies sued the South African government over pro-health amendments in their patent law. Since 2006, they have been suing the Indian government over the health safeguards (Section 3d) in its patentlaw. India supplies generic medicines across the developing world and health and PLHIV groups in India have been using Section 3(d) of the Indian law toensure that key medicines stay off-patent. Novartis did not get a patent inIndia on a cancer medicine and wants this law (Section 3d) weakened. BUT THIS WILL IMPACT ALL OTHER GENERIC MEDICINES AS WELL.
Brussels, 7 February 2012 - Supporting the ongoing Global Week of Action on the EU-India FTA, Pauline Londeix of Act Up-Paris today confronted the European Commission for Trade, Karel de Gucht at a “Civil Society dialogue on Trade, Growth and development” at the European Commission. De Gucht reportedly leaves for India tomorrow for the EU-India Summit on 10th February 2012 where the E.C. is putting pressure on the Indian government to announce political trade-offs in the EU-India FTA.

This afternoon, Act Up-Paris protested in front of Novartis-France headquarters in Rueil Malmaison, a town near Paris. The activists blocked the entrance of the building and shut the gate. They unfurled a banner which said « Over our dead bodies », recovered the entrance of fake-blood and chanted slogans such as « Shame, shame, shame on Novartis». Novatis decided to call the police. The protest aimed to denounce the policy of the Swiss firm which is suing the Indian government in Court. The next hearing will take place on the 17th October in New Delhi. If Novartis wins, the ability of India to produce cheap generic medicines for new molecules will be strongly affected. This is a declaration of war to people living with the diseases worldwide. Act Up-Paris condemns this action of the vulture Novartis.
